Intellectual Property Protection – A Key to Growth

Globally, the United States is considered one of the healthiest open markets. This open market system allows entrepreneurs, small businesses, and large corporations to bring a vast variety of products and services into the American market. The spoils of success are returned to the share and stake holders of the business because the United States economy is not socialistic in nature. This economic atmosphere fosters an environment where innovation is encouraged and technology progresses daily. However, an issue that many of these businesses face as technology becomes more readily accessible to the average consumer is the protection of intellectual property. The intent of this article is to educate the reader of the importance of intellectual property and reveal the most common forms of protection.

Intellectual Property Issues

Rapid movements towards globalization have slowly transitioned from a domestic problem to an international problem as well. This is important considering “studies in the past decade have estimated that over 50 percent of U.S. exports now depend on some form of intellectual property protection, compared to less than 10 percent 50 years ago” (“Intellectual Property”, 2012, para. 6). These statistics reveal the fact that foreign customers want to learn the technology behind the product regardless of the ethical boundaries in doing so. It also indicates that these economies want to evolve from being an exporter to a competing producer adversely affecting market share of the host company. This action of infringing on other businesses intellectual property rights will often occur without being noticed until the information has already been compromised. The results from this can be detrimental once the safeguarded trade secrets are exposed.

Duffin and Watson (2009) indicated that, “Intellectual property may well be a franchise system’s most important asset” (p. 133). This may include “trademarks, service marks, trade dress, copyrights, patents, and trade secrets” (Duffin & Watson, 2009, p. 1). Dependant on the business function the intellectual property may be the sole means for survival within the market place. When considering expansion many businesses may not move critical portions of the operation into foreign economies. Some firms are so cautious that “some of these elements may have been deliberately withheld from the firm’s patents, in the United States and in the foreign country, in order to prevent other parties from being able to copy its technology” (Branstetter, Fisman, & Foley, 2006, p. 323). The purpose behind this approach is that once a business applies for a patent the business must disclose all the details. This patent then becomes a public record. David Leonhardt (2011) from the New York Times reveals to their readers, regarding such nations as China, that “the exchange rate is not the main problem for American companies hoping to sell more products” but the lack of protection to foreign investors (para. 3).

Newton (2008) stated, “The U.S. Constitution speaks of protecting the writings and discoveries of authors and inventors, and thus the importance of protecting intellectual property is fundamental to the American legal system” (p. 1). The United States has developed various means for entrepreneurs and businesses to protect what they consider as intellectual property. When property rights for businesses are strengthened it will in return “induce more innovation in the global economy, thereby fostering more rapid economic growth” (Branstetter et al., 2006, p. 321). As mentioned, many businesses will invest enormous amounts of resources or delay expansion in an effort to develop strategic plans that will ensure that their trade secrets are safeguarded.

Intellectual Property Protection

The first step for a business is to determine if any facet of the business qualifies to be considered intellectual property. For trade and service marks the “most basic vehicle” for protection is registration. (Duffin & Watson, 2009, p. 133). To register for this protection businesses apply to the U.S. Patent and Trademark Office. Duffin and Watson (2009) also alert readers to the fact that this action is the “prima facie evidence of a mark’s validity” (p. 133). However, a business that is considering international operations will also have to file “nationally through each local agent in each jurisdiction; filing an application for an International Registration under the Madrid Protocol” (Duffin & Watson, 2009, p. 134). Next, a company may determine that their company possesses material that qualifies for copyright protection such as “literature, music, drama, graphic design, sound recordings, and architecture” (Duffin & Watson, 2009, p. 135). This property right provides a great length of control for the author by providing exclusive rights “of reproduction, distribution, derivative works, right to create derivative works based on the… original work, public performance, and public display” (Duffin & Watson, 2009, p. 135). Copyrights can be applied for through the Copyright office in the Library of Congress. The final most common form of intellectual property protection comes through patents. However, many companies will prefer to retain trade secrets rather than disclose information that is required to apply for this protection. Generally, patents have life spans of fourteen to twenty years. Duffin and Watson (2009) explained that “there are three basic types of patents; plant, design, and utility” (p. 139). After a review of the application by the U.S. Patent and Trademark Office a business can be granted patent rights to their intellectual property.

Conclusion

Protecting intellectual property for businesses is crucial for both those who are just beginning and those who are already considered household names. The leadership element has a responsibility to the share and stake holders to ensure that all the necessary steps have been taken to protect the intellectual property within the business. In summary, protection occurs through registration, copyrights, patents, or the internal controls governed by the business. The first step begins by properly identifying the critical functions of the business.

Identifying Potential Do-It-Yourself Opportunities to Enhance Home Improvement

There are many home improvement opportunities an individual can take advantage of when trying to improve the appearance of their home and increase the value of their property. While hiring a professional may provide a nice opportunity in relation to convenience, the incredible expense associated with these services can often encourage individuals to seek alternatives. When looking into the opportunities that exist with alternatives for your housing improvement projects, take advantage of the do-it-yourself opportunities that exist with landscaping, painting, flooring, and bathroom remodelling.

Landscaping

The appearance of a home is often directly related to the common real estate expression of curb appeal. When you have a property that has vegetation, which is out of control or offers very little character, it can help in deteriorating an individual’s opinion of your home, before they have even viewed the interior. When looking to improve your home’s curb appeal, the do-it-yourself landscaping home improvement solution can offer many advantages, as you look to spruce up your existing environment and improve appeal through cost-effective projects that can complement the look and feel of your home.

When looking to significantly alter the interior or exterior of your home, one of the most efficient methods you can take advantage of is found with do-it-yourself painting. This home improvement opportunity can enable you to completely alter the feel of your home. Simply by changing your color scheme you can give your rooms new, unique ‘personalities’. Whether you are painting a room for a child or looking to create a welcoming living room environment, the resources of painting can provide you with many incredible possibilities.

Similar to the opportunities that exist with painting, flooring represents another unique opportunity that can help to completely change the environment this flooring exists within. If your home is covered in old carpeting, then a fresh change of wood or stone flooring can prove highly beneficial. If you have outdated linoleum, the do-it-yourself solution of ceramic tiles or stone can help to accent a kitchen or bathroom.

Bathroom Renovations

Another incredible do-it-yourself resource that homeowners can take advantage of, when looking to benefit from the objectives of home improvement, can be found with bathroom remodels. Bathrooms are often environments that are very personal, and the difference a clean, bright look gives to the room’s ambiance should not be underestimated. A remodelled bathroom can prove highly attractive to potential investors, as they will get a better return for their investment due to the appeal of new features, rather than worn and outdated materials.

Best Cities For NRIs To Invest In Real Estate

NRIs often hear stories about investors hitting jackpot by buying and selling properties back home. Very often, they also hear about someone who has lost money in a project that never materialized or in which issues crept up, rendering the property impossible to sell.

Eager to bag a slice of the pie, the NRI begins researching how to invest in the Indian market from abroad and which city, to begin with, only to get lost in contradictory sources.

It is a fact that the Indian economy is expanding rapidly; in fact, the World Bank projects that India will surpass China as the world’s fastest growing large economy by 2017. For those looking to become real estate investors who wish to participate in India’s growth, choosing which part of the country to buy-in can be a challenge. After all, the economy may be making great strides at the national level, but what forces at work at the local level? Put another way, which city or cities can promise the greatest returns?

We have compiled a list of the best cities for real estate investment. Some of these are large metros, known to be the hubs of many industries. Others are smaller, upcoming cities which show a lot of promise in their growth rates in population and per capita income amongst other factors. Read on to identify which city may be the best for you to invest in real estate.

1. Bangalore

Thanks to its combination of rapidly growing population, well-paying jobs, and low real estate prices, the hub of India’s IT industry has become the hub of its property investment as well. JLL recently published its annual ranking of the world’s most dynamic cities, in their City Momentum Index, affirming that Bangalore is the fastest-changing city on the planet.

By some estimates, 40 percent of India’s IT industry is based in this one metropolis. These changes have made it the most attractive place in India for real estate investment. A recent survey pegged Bangalore as the top real estate opportunity across Asia-Pacific.

All of this makes Bangalore the most desirable place for real estate investment in India.

2. Pune

Pune has displayed rapid population growth over the past decade with a growth rate over 30% during this period. The average white collar salary in this city is second only to Bangalore. Currently, property in this city is affordable as compared to other cities, which shows that it’s a good time to invest.

The city also benefits from being close to Mumbai. It also holds opportunities in the education, IT, automobile, and engineering sectors. This is yet another example of a formerly slow city that has experienced rapid recent growth and change.

The good weather all year round is an added benefit for NRI investors here. A new international airport and increased metro connectivity will bring even more growth and positive change to the city in coming years.

3. Chennai

Head over to the capital of Tamil Nadu for yet more real estate investment opportunities. Chennai is also in the leading pack, with a high growth rate in population (30%) and reasonably high average white collared salaries. This industrial city also has many companies that do IT and financial services.

The government has made road connectivity a priority here in recent years. This has helped the city and the surrounding area develop faster and attract new business opportunities.

A coming monorail and elevated railway line are sure to further help with this connectivity.

4. Visakhapatnam

As far as population and area, Visakhapatnam (Vizag) is one of the biggest harbors in India. Because of this, it is considered the commercial hub of Andhra Pradesh.

A quickly growing IT industry coupled with good infrastructure makes this city a desirable place for real estate investments.

With the first phase of the Vizag Metro Rail slated to be completed in December 2018, transportation options will also soon open up in this city.

5. Mumbai

As a growing city with modern urban development, Mumbai is a good real estate investment choice for a non-resident Indian who cares about lifestyle.

Considered the financial capital of India, this city is hard to beat when you compare the level of infrastructure with other cities. Target a premium property in an upscale neighborhood for the best return on your investment. There are several luxury hotspots in Mumbai that place you near high-end retail stores and restaurants.

As India’s financial hub, Mumbai also attracts many investors and corporate firms, providing plenty of work opportunities. If you want an internationally competitive work culture, this is the city.

Mumbai has great education facilities, including international schools. Political stability and easy resale options are added incentives to make Mumbai your investment realty location.

6. Bhiwadi

As the third-largest industrial hub in India, Bhiwadi is a manufacturing hub for some major firms. Companies like Gillette and Honda ensure plenty of local work opportunities.

Real estate projects are also cheaper here than in other cities. The affordability right now makes this a great investment realty choice for the long term.

The Indian government has proposed projects in Bhiwadi including new high-speed public transportation. This will make this city even more desirable in the years to come.

7. Kochi

Kochi, the commercial hub of Kerala, has seen new real estate prospects thanks to recent changes.

An upgrade of the sea port and privatization of the local international airport brought in new business prospects.

Many NRIs are already investing in Kochi. In fact, only some 30% of investors in real estate in Kochi are locals.

Part of what makes this city so appealing is its recent developments in infrastructure. New planned developments include the Vallarpadam International Container Trans-shipment Terminal, which will expand investment opportunities for this port city.

An “oceanarium,” or marine research facility that also doubles as a tourist attraction, is another proposed project that’s sure to attract even more opportunities to the area.

8. Bhubaneswar and Cuttack

These twin cities in east India are growing education and IT hubs. This boosts real estate development in the area.

The real estate market is well-regulated here since most of the available land is still owned by the government.

Plans for new commercial projects, a wider highway, and the new Kalinga Nagar Industrial Complex add to the reasons to target Bhubaneswar and Cuttack for real estate investment.

9. Coimbatore

The second largest city in Tamil Nadu boasts a stable industry that revolves around textiles and spinning.

Engineering, IT, and manufacturing have added to the industry in Coimbatore in recent years, providing economic growth and increased work opportunities.

A planned airport expansion will increase the ease with which travelers and business opportunities can flow into the city. And a proposed bus rapid transit system provides added options for transport on the ground.

Conclusion

There is a long list of cities in India that are great opportunities for real estate investments.

You may choose an established, major hub like Bangalore, or a newer and growing location like Kochi. It all depends on exactly what your future plans are for your investment.

Improve Your Poor Credit Score and Secure Yourself a Loan

So you are thinking of getting some extra money to make some urgent home repairs, the porch door needs replacing, along with a new hot water system. Unfortunately you do not have the money in the bank, but neither do you have a secure porch door or any constant hot water.

Have you considered personal loans? A lot of people take out personal loans for this type of repair. Car repairs and even holidays are used by people with their newly acquired finances. Most people have heard that a poor credit score is not a good thing (However even those that have a poor financial history can still get loans). But how do you make a good rating?

One of thing major pieces of advice from experts, before you apply for finance it is best to get a credit report completed from a reputable source. This will give you an idea of the chance of getting your application approved. In the United States of America there are three levels of credit rating, basically the higher it is the better it is.

An excellent rating is above 760, a good rating would be between 700 and 759 and a poor rating would be between 640 to 699. if you are at the top end, 760 and above then there is no point in making your rating any better. However with other ratings it is worth trying to improve as it will help your chances of succeeding in the application.

There does seem to be a bit of a chicken and egg situation sometimes, you need finance but have a poor score, but to improve you need a lender to give you a chance. Well, luckily there are things that you and your family if you have one, can do to improve your rating.

Having a poor rating does not mean you have to be stuck with it, starting to pay the bills on time instead of late or not at all will start to get you on the right path. Some lenders will still give applicants loans even with a low score, but the total given will be lower than usually and the percentage rate will be considerably higher. So you will pay more over the period of the finance.

Families can help too. If a member of your family has a good rating then some credit card companies can add you to that family members credit card as an authorized user, this will help with any poor credit score. Also having a family member with a good rating co-sign the loan could help you get what you need.

Finding the correct lender for your score is a good way to make sure that you are getting what you deserve, if you have a high score you deserve some of the best deals on the market. Instead of going to your bank or card company you can go online and search for a matching company. Companies like this are a good place go to make sure you achieve the best deal.

What are a matching company and what do they do? You enter your details on their online program and your information will be fed to several of their approved lenders, in turn the lenders will then return to the matching company with a list of loans that they are able to offer.

Once the offers come back it is then up to the applicant to choose one and complete all the necessary paperwork. A check will then be received within a matter of days and your new boiler and door fitted soon after.

Are Online Personal Loans Good For People With Bad Credit?

While the rise of online lending in itself makes it more convenient for people to apply for finance, is this development a good thing for those who are already struggling? There are companies out there who charge expensive annual percentage rates (APRs), leaving many people in more trouble than when they first started.

But it doesn’t have to be this way. Over the last few years, online lending has earned itself a bad reputation. The internet leaves many people vulnerable to fraud, so you should always exercise caution when inputting your financial details. The best way to make sure your information remains safe is to find a secure, reliable lending platform.

There is an unfair irony attached to lending today. Those with bad credit are often led to believe they have no financial options if they have made mistakes in the past, often making their situations seem more desperate than they actually are. This can result in people making bad decisions and can lead to borrowing through unstable sources.

Meanwhile, any lenders that do accept you with bad credit will charge extortionate interest rates because of your history, making it more difficult for you to meet your monthly repayment obligations – thus worsening your situation. This is a trap that many people fall into, and it gives online installment lenders a bad name.

However, this doesn’t need to be the case. If you can find yourself a reliable lending platform, you will be connected to a secure network of trustworthy lenders who can offer sensible solutions to your borrowing needs. Many of these lenders will assess your application, even if your credit file isn’t perfect or your income is lower than average.

Instead of (or in some cases, as well as) running credit checks, these lenders will take other factors into consideration, including your income and employment circumstances, and how long you have lived at your current address. They may even ask for references they can contact who will vouch for your character personally.

Even those who receive benefits as a form of income will be able to apply, giving everyone a fair and carefully considered chance of borrowing money. In these cases, applicants won’t be accepted for higher loans than they can afford to pay back, and interest rates will be low, meaning there is a better chance of managing repayments.

If you have poor credit and need to borrow money, consider a personal installment loan, but make sure the APR is advertised between 5.99% and 35.99%. There should also be a number of options in terms of flexible repayment, offering you the chance to pay the money back anywhere between six months and six years, depending on what you can afford to pay per month.

Small, carefully considered personal loans could actually help you build a financial profile making you eligible for better future borrowing. As long as the lender is responsible, and offers reasonable interest rates, online lending platforms can actually give people with more opportunities than many other lenders in terms of improving their situation.

With this in mind, personal loans can be beneficial to those hoping to improve their credit score, but only if some caution is exercised by both parties, and you only apply to borrow an amount you can afford to pay back.

Five Reasons for Refusal of a Personal Loan

Don’t you wish personal finance were a mandatory course in college? Unfortunately, too many of us learn by mistake. When you need a personal loan and are rejected, you might be baffled as to what went wrong- and how to fix it. Here are some clues.

NO CREDIT

No credit is a situation where you have never used credit and therefore have no credit history for the bank to review. They have no way of making an educated decision on whether or not you will pay back a personal loan based on your credit history. No credit is worse than bad credit. Qualifying for and making regular payments on these types of introductory forms of credit can overcome a “no credit” score:

· Student Loans

· Secured credit card (includes a down payment amount)

· Being added to a parent’s or spouses good credit: card, car loan, etc.

LOW CREDIT

Low credit takes on several forms. If you’re using more than 30% of your allowable debt, it can negatively impact your score. Too many inquiries from shopping around for loans will also hit you hard. Lapses in payment, defaults, or bankruptcies are giant red flags and can take a long time to rebuild from.

Other things that lenders may look at are whether or not you have sizeable assets should you default on the loan. They also check to see if your debts are diversified or if you are only carrying one type of debt.

INCOME

Proof of income is generally required when applying for a personal loan. If you are unemployed or underemployed, it can work against you in the loan approval process. Lenders may also require a work history to see how long you have been with your current employer, and to determine if you typically have job stability. Frequent job loss or change will tell a creditor that your payments may not be reliable.

PURPOSE OF THE LOAN

Believe it or not, your application can be rejected due to your proposed purpose for the loan. Financial institutions have the right to set up the parameters surrounding their disbursements and can accept or reject your application based on what you want to use the money for.

BLACKLISTING

If you’ve defaulted on debt before, your name may be put on a list of whom not to loan to,’ also known as a “Blacklist.” This will follow you around for a long time and is difficult to erase. If you do resolve the debt issues, get documents to prove the resolution.

How Can A Personal Loan Improve Your Credit Score?

When it comes to a personal loan, you have to first learn to use it responsibly. Because if you miss a repayment, your credit score will be impacted adversely. And remember, that a credit score is an indicator of how well you manage your personal finances. Also, it plays a defining role when you apply for any kind of loan – secured and unsecured. It is suggested to apply for a loan slightly larger than what is needed so that you will be assured to have enough money to pay all bills necessary and still have some money left over to ensure that your bank account stays current.

A credit score can be defined as a number which reflects the financial situation of a person. If the person is well-off when it comes to financial matters, then he or she is said to have a high credit score. On the other hand, if a person is the exact opposite of this, then they possess a low credit score. There are a lot of factors that are considered by financial institutions for the purpose of evaluating a person’s credit score – usually, the credit scores of people vary from 300 to about 850.

A personal loan is a type of loan that is given by digital lenders, banks and credit unions to aid you in your plans, be it starting a small business, or making a big purchase. Personal loans tend to have an interest rate(s) lower than the credit cards; however, they can also be put to use for combining several credit card debts together into one monthly lower-cost payment.

Now, your credit score is built by keeping in mind various parameters from your credit reports. These reports serve the purpose of trailing your history of utilization of the credit across the duration of seven years. These credit reports are comprised of information, including how much credit you have utilized to date, the type of credit in your possession, the age of one’s credit accounts, whether one has put in for bankruptcy or liens filed against them, actions of debt collections taken against them, one’s total open lines of credit as well as recent inquiries for hard credit.

Like any other type of credit, personal loans are very capable of affecting your credit score. This can be done through the process of applying and withdrawing a personal loan. If you are curious as to how personal loans can end up affecting your credit, then read on to find out more about the context. There are many ways in which your credit can be affected by personal loans and some of them are listed below:

The ratio of your debt-to-income and loan

Debt-to-income ratio is considered to be the measure of your amount of income that you spend on the debt repayments. In the case of lenders, the amount of income that you receive is said to be one of the major factors proving that you are able to repay your loan.

Some of the lenders have come up with their own debt-to-income ratio so that their proprietary credit scores may make use of it in the form of a credit consideration. Do not fall into the kind of mindset that possessing a high amount of a loan would hurt your credit. The most damage it can do is raise the ratio of your debt-to-income so that you won’t be able to apply for loans anymore without it getting rejected or denied.

Paying loans on time will make credit scores soar

The moment your loan is approved, you have to make sure that you settle the payments of each month on time and in full. Delay in repayment may significantly impact the state of your credit score. However, on the other hand, if you make the payments on time every month, then your credit score will soar high, leading to an overall good score. This will not only make your name to the preferred borrower’s list, but it will prove to be beneficial for you in the long run.

Since your payment history is comprised of almost 35% of your credit score, paying loans on time is essential in cases like these so that your credit score can maintain a positive status.

Variety is built into your credit type

There are about five factors that are responsible for determining your credit score. These are composed of the payment history, the length of the credit history, the utilization ratio of the credit, the credit mix and new inquiries of the credit in accordance with FICO®.

The credit mix only accounts for about 35% of your total credit score, whereas when it comes to a personal loan you can have a varying mix of the credit types. This mix of all types of credit is viewed at a high level of approval by the creditors and lenders.

Origination fee charged by loans

Most of the lenders end up charging you an origination fee. This fee cannot be avoided at any cost and is instantly taken off from the amount of the loan payment. The amount of origination fees depends upon the amount of the loan you are about to borrow. Late payments can lead to an overdraft of fees and late expenses. Therefore, make sure that you pay complete repayment for each month before the deadline.

Avoiding penalties when it comes to payments

Some of the credit lenders tend to charge an additional fee if you end up paying your part of the loan earlier than the agreed date. This is because they are looking for moderate amounts of interest on your loan. Now, seeing that you have paid off your part of the loan before time, they will miss out on that interest that they could have possibly made if you had not cleared the debt soon enough before the deadline.
